The area of employer-employee relations is complex and ever-evolving with new laws and court interpretations. Nauman Smith concentrates in advising management on how to adopt policies and practices, or address specific situations prior to, and with the intent of avoiding, litigation. Advice and counseling in this complex field includes such areas as the Americans with Disabilities Act, sexual harassment and other employment discrimination matters, the Family & Medical Leave Act, hiring and firing, wage and hour laws, contract employee and independent contractor relationships, performance evaluations, and employee discipline, to name just a few. When matters do lead to litigation, or an employer first contacts the firm at that juncture, our attorneys have represented employers before state and federal courts and before administrative agencies such as the Equal Employment Opportunity Commission, the Unemployment Compensation Board of Review and the Pennsylvania Human Relations Commission. We have also represented employers in collective bargaining negotiations, labor contract interpretation, and employee grievance matters.
Although primarily representing employers, the firm also represents individual employees on a select basis. These cases have included sexual harassment matters, terminations of employment, and employment contract matters.
