Duty to Stop, Look and Listen Reaffirmed
In a lawsuit with multiple defendants, Nauman, Smith, Shissler and Hall successfully represented a railroad client in a train-vehicle collision case on appeal before the Commonwealth Court, which upheld summary judgment rendered in the railroad's favor and against the plaintiff, who claimed debilitating and permanent brain injury by the trial court on all counts. The trial court's finding that the plaintiff was more than 50% negligent as a matter of law was also affirmed by the Commonwealth Court. The duty to stop, look and listen was reaffirmed upon petition for reargument, also decided in the railroad's favor. A request by the plaintiff for permission to appeal is currently pending before the Pennsylvania Supreme Court.
